I am settling two insurance claims. The companies say I must do a Medicare set-aside and not be able to keep my money. What is it? Is it a tax for Medicare on settlement? Do I legally have to do it?

All parties in a Workers' Compensation (WC) case have significant responsibilities under the Medicare Secondary Payer (MSP) laws to protect Medicare's interests when resolving WC cases that include future medical expenses. The recommended method to protect Medicare's interests is a Workers' Compensation Medicare Set-aside Arrangement (WCMSA), which allocates a portion of the WC settlement for future medical expenses. The amount of the set aside is determined on a case-by-case basis and should be reviewed by CMS, when appropriate. Once the CMS approved set aside amount is exhausted and accurately accounted for to CMS, Medicare will agree to pay primary for future Medicare covered expenses related to the WC injury

I about just had a question liability. I had an automotive accident the other day. There is the possiblity of an injury in the other party; the accident was my fault. My insurance covers up to only $25,000 for personal injuries. Suppose that the opposing party needs a significant amount over that. I am an 18 year old without much money. Are my parents liable/are they required to fork out the money? I am dependent under them by law and we are all on the same insurance policy. I reside in State of Texas.

Yes your parents are liable. I was in a wreck when I was 17 in 2004. The other party was injured when I hit them. My parents are currently being sued for this wreck. You are considered a minor in the court of law until you are 21. So therefore, my parents are liable for my wreck. I "supposivley" injured the other party and we are in a lawsuit right now. If they win then my parents will owe them whatever she is suing us for. My parents only had coverage for $25,000 also so theywill owe her whatever she wants over that amount. Since I am now an adult she can sue me along with my parents. Lawsuits take a very long time to settle so they can get money from you too when you turn 21 and from you parents also. I reside in the state of Mississippi so I am assuming we have the laws.

While riding dirt bike on private property my son hit a pile of rubbish, went airborne across road between this property and his place of residence and hit side of residence. He sustained multiple injuries - 10 days in Intensive Care and 5 weeks in Hospital. Date of accident was 01/10/2000. He was 12 at the time (dob 12/01/88). We were told at the time that he would not have a case for personal injury claim but current advice indicates he may. We have been given two conflicting opinions as to when a claim would need to be lodged. One opinion is 9 mths from when he turned 18. The other is 3 years from turning 18 ie 21 years of age.

The statute of limitations is about to run out if it hasn't already. it does not matter the age of the litigant. You must file the claim in a timely manner. You had better hurry!!!!!!!

Had an accident in August, insurance companies want to go 50/50 as the man that hit us is a liar. A named driver was driving at the time of the accident, so would the named driver and the policy holder both loose their no claims bonus?

No - only you (and the liar) will lose their no claims bonus as the claim is being made on your policy.

The named driver will have to declare that they were involved in an accident to his insurers (as soon as possible) if they have their own insurance policy, or should they take out insurance - for the next three years,

I was involved in an accident earlier this month in my 03 Chevy S-10 base pickup. The shop deemed it a total loss (which I expected from what little I know about car insurance claims). I'm researching prices to have some negotiating leverage when I will (eventually) be talking to the total claims adjuster.
