Several days ago, I was a passenger in car accident. We had the right of way at traffic light (green light), crossing the intersection and going straight and someone from Left Hand Side Ran Red Light and Hit Us. I went to the hospital for Back Pain, Knee Pain, Chest Pains and diagnosed as Severe Contusions. Does this also count towards Bodily Injury? What claim can I make, If any?

The Police Report has been also obtained and other driver has been found at fault. The situation is complicated, as other driver had Unexpired Tags, Unexpired Insurance, Unexpired Registration. I went to the hospital for Back Pain, Knee Pain, Chest Pains and diagnosed as Severe Contusions (Crushing of Tissue in Knee and Chest). Does this also count towards Bodily Injury? What claim can I make, If any?
In terms of the Vehicle, The Front of Vehicle was totally engulfed in Flame, as Engine Blew Up. Also, the Front of car is totally smashed in.
In terms of the Accident, It occured in State of New Jersey. I have my own Drivers License, Car and Insurance through State of Delaware, as I have legal residence there. Why not go to lawyer?

i think not as bad maybe b'coz of the high impact thats why you feel body pain and about the confusion maybe b'coz you're afraid or you're shock b'coz of the accident try to see a psychologist.

my husband was in an accident with a drunk driver and 2 other vehicles a couple of nights ago. his neck was injured. he was slammed 3 times. he went to the er that night. tomorrow he is going to dr for follow up. (neck is worse by the way). my question is this- the drunk drivers ins accepted liability and is going to cover our van, rental car, as far as med bills they said we can either get a settlement from them directly from injury claim or we can go through our insurance (med pay?) and then our insurance can get their money back from the other company. any insurance agents or someone who has been through this that has advice? thanks in advance.

I don't know if you want to go this route, but you may want to contact a lawyer. I was in an accident about 2 months ago, and even tho the other guys insurance accepted liability, I had to get an attorney for the injury part. The ins people will do whatever they can to pay you the least amount possible, sometimes trying to pay less than your dr bills! And your ins company is still an ins company and will do the same thing probably. I really didn't want to have to go thru all this hassle, but once I realized the pain wasn't going away, I had to make sure I'll be covered in the end. And he will probably feel worse everyday for about a week! My pain just kept getting worse too. Good luck to you! Glad he is not too hurt!

i wanted to add to this since its not closed, to tell you the latest, so you know what to expect. My car was totalled in the wreck, and the KBB value of it is at 3500. The ins called trying to offer me 1700!! Talking about thats what they have it worth!!! I'm still in shock. And this is from my insurance company! Like I said, they're just trying to get over anyway they can. I did refuse the offer. That's not even half what the car is worth! Oh, and my rental car time from insurance is up now, but I still have no check to get another car. Go figure. All bc some jacka$$ hit me!!!

My take on it is that they are both named drivers on each others insuances .Husband buys top of the range car, & wife has small runaround to take kids to school, do the shopping etc. Husband lets wife 'borrow' car at weekends. BIG mistake. She sees that his car is better equipped than hers, & uses moral blackmail -'the kids are safer in your car', I feel safer as well. Let me use it. In doing so they are brow-beaten into submission. Next step, wife has small accident in his car, husband claims on his insurance and the die is set.He loses no- claims bonus while building up her no- claims bonus A chap I work with has a new car every 2 years but he never drives it, he has his wifes car ( which is a total mess inside, being a dumping ground for toys, dog blankets etc) 'because it is more economical ' to run than his. When we comment on this he just says ' Its easier to say nowt and keep the peace

My theory -
A woman backs into a guy's car, gets out and starts BAWLING!!! "ohh my husband is going to kill me blah blah blah" so the guy, being a guy and having no patience for the blubbering, says "its not that bad" and leaves, because he's tired already of hearing the "woe is me" crap from the woman.
And THAT"S why women have fewer insurance claims!

I'm just wondering how much lawyers charge for insurance claims. What percentage of final settlement do they usually take?

They usually charge 33% of the claim plus expenses. The expenses will add up to 12% to 17% so they will get 45% to 50% of the total settlement.
